Commercial Property Insurance Claims

The short answer

A properly written commercial property policy can be the difference between reopening after a loss and closing for good. Michael Sapourn helps Florida businesses pursue building, business personal property and business income claims, and evaluates whether an agent's advice left the business underinsured.

Getting the coverage right before the loss

If your agent worked with you to design and regularly update your coverage, you should be in good shape when disaster strikes. The critical starting points are:

  • Replacement cost limits for buildings and business personal property, updated as construction and equipment costs change
  • Business income (business interruption) limits based on a real analysis of your income, fixed costs and how long it would take to reopen after a worst-case loss
  • Special coverages for inventory on delivery vehicles, property at job sites, and property of others in your care
  • Keeping your agent informed about new locations, inventory and expansions

When the claim is disputed

Even a well-designed program can run into trouble when the claim is presented. If your insurance company is not treating your claim fairly, or your agent failed in their duty to advise you about coverage, call Mr. Sapourn for a free consultation.

A commercial lines background

Before becoming CEO of his agency in 1987, Mr. Sapourn ran its commercial lines department. He has testified as an expert witness on commercial property questions, including whether specialized equipment was part of the insured building and how business income coinsurance should have been handled. He represents businesses in Melbourne, Brevard County, Orlando and across Florida.

Frequently asked questions

Does business interruption insurance cover lost income?

Business income coverage pays for lost income and continuing expenses after a covered physical loss, subject to the limits, waiting period and coinsurance terms in your policy. Setting the right limit requires a careful analysis of income and fixed costs.

My business was underinsured. Is that my agent's fault?

Possibly. If your agent took on the role of advising you on limits and values and did not do it properly, the agent may share responsibility. Mr. Sapourn has testified on this issue, including a case about business income coverage placed with 90% coinsurance when a no-coinsurance form was proposed.

What should a growing business tell its agent?

New locations, inventory and equipment value changes, additions to buildings, and property kept on vehicles or at job sites. Coverage that is not updated as the business grows may not respond fully to a loss.
